Contest Rules for NZ GenArt Fusion 2024 (Online)

1. General Provisions
1.1. The organiser of the Online AI Art Competition (hereinafter referred to as the "Contest") is Mytona Limited with the registered address at Level 5, 129 Hurstmere Road, Takapuna, Auckland, New Zealand, 0622 (hereinafter referred to as the "Organiser").
1.2. The Contest is not a lottery and does not require any purchases.
1.3. The Contest will be held via announcements on the Organiser's official website https://mytona.co.nz/ (hereinafter referred to as the "Organiser's website") and through communication on Discord.
1.4. The Contest is not sponsored by, managed by, supported by, administered by, or connected in any way with Discord or any other third party. Participants provide all information and data to the Organiser, not to Discord.
1.5. By participating in the Contest, participants agree to these Contest rules (hereinafter referred to as the "Rules").
2. Schedule, the theme of the Contest and requirements
2.1. The registration for the Contest begins on July 8, 2024 and ends on August 23, 2024.
2.2. The Contest begins on August 24, 2024.
2.3. The theme of the Contest will be announced on the official Contest Discord channels and will be sent to participants via email at the Competition Start Date.
2.4. Submission Deadline: Participants will have 24 hours from the announcement of the theme to complete and submit their entries.
3. Eligibility
3.1. The Contest is open to students of universities, colleges, and high schools who are over the age of 18 on the date of registration and are enrolled in educational institutions in New Zealand.
4. Registration Details
4.1. Participants must register for the Contest via the official Google Forms link.
4.2. Registration requires providing accurate personal information. By completing the registration form and providing their personal information, participants consent to the collection and use of their personal information as described in the privacy consent form linked within the registration form.
5. Submission Guidelines, and Entries Requirements
5.1. Entries (hereinafter referred also as the "artwork") must align with the announced theme.
5.2. Submissions should be AI-generated artworks created by the participant specifically for this competition. Plagiarism or unauthorised use of copyrighted Artworks is strictly prohibited.
5.3. The submitted artwork must:
Not contain images of people or information about them without their consent.
Not violate moral or ethical principles and laws.
Not violate any rights or legitimate interests of third parties, including, but not limited to, rights to trademarks, copyrights, related rights, and privacy.
Not include slanderous, unlawful, hateful, offensive or politically sensitive elements. A hateful element is any element or its part that promotes or encourages discrimination, denigration, harassment, or violence.
Not promote harmful environmental practices or negative social impacts.
Be respectful and considerate of all cultures, communities, and individuals.
Not contain NSFW content (explicit sexual content, extreme violence, or other inappropriate material).
Not directly imitate existing artists' styles (combinations and inspired styles are permissible).
The entrant guarantees that no other third party has rights or grounds to claim the artwork based on reasons such as a publishing or developing contract or any other contractual relationship. In the event that the status of the artwork changes, the entrant agrees to immediately notify the Organiser.
If the artwork violates these requirements, it may be removed, and the entrant may be excluded from the Contest.
5.4. Participants must disclose all AI tools and software used in the creation of their artwork.
6. Submission Process
6.1. Participants must upload their artwork and accompanying proof via Google Forms, linked to a Google Drive folder.
6.2. Required submission details include:
The artwork.
AI Tool(s) Used for Artwork
Metadata, seed, and prompt of the AI tool used.
Links to any other tools or materials used.
If modifications are made using software (e.g., Photoshop), include the working file.
6.3. All submissions must be received by the stated deadline.
6.4. File Specifications:
minimum resolution: 1024x1024 pixels;
maximum file size: 100 MB;
acceptable formats: JPG or PNG;
without watermarks or signatures.
6.5. Collaboration and Team Submissions:
Entries must be submitted by individual participants only; no team submissions are allowed.
Collaboration with other participants is prohibited.
6.6. Submission Limits:
Each participant is allowed to submit a maximum of three entries.
Multiple entries must be distinctly different from each other in terms of concept and execution.
7. Judging and Criteria
7.1. The winners will be determined based on originality, creativity, relevance to the theme, technical execution and aesthetic appeal.
7.2. The judging panel will consist of experts in art and technology appointed by the Organiser.
7.3. The decision of the judging panel is final.
8. Communication
8.1. All communication with participants will be conducted via Discord.
8.2. Participants must join the official Contest Discord channels to receive updates and instructions.
8.3. Newly registered participants will have access to a limited set of channels initially. Access to additional channels will be granted as the contest progresses.
9. Award List
9.1. Prizes will be awarded for the top three entries. Additional prizes may be awarded at the discretion of the Organiser.
9.2. Receipt of the Awards by the winners is contingent on compliance with all relevant legislation and regulations, as well as these Rules. The winners bear all tax, transaction and other costs/expenses. To receive the Awards, the entrants must submit the required personal data and consent to the processing of personal data. In the case of failure to provide the required data in reasonable time, the winner loses the ability to obtain the Award.
9.3. Prizes will be delivered only within New Zealand, delivery is at the Organiser's expense.
If the winner is located in Auckland, the prize must be collected from the Organiser's office.
10. Intellectual Property
10.1. By submitting an entry, participants grant the Organizer a royalty-free, perpetual, transferrable, exclusive, irrevocable, and unrestricted licence to publish, distribute, reproduce, and create derivative works from the entry for the purpose of promoting and covering the Contest. This licence is granted to the maximum extent permitted by the terms of service of the AI tools utilised to create the entry.
10.2. Participants are solely responsible for ensuring that their submissions adhere to the licensing terms of the AI tools used to generate their artwork. The Organizer will not verify compliance with these terms and assumes no responsibility for any licensing violations. It is the responsibility of the participants to secure any necessary commercial licenses, if applicable.
10.3. Participants confirm that they have obtained all necessary permissions and licenses for the use of any AI tools or other resources employed in the creation of their submitted artworks. They must also ensure that their use complies with the respective terms of service of those tools and resources.
10.4. The winning artworks may be used as the Contest banner for the following year and subsequent years.
10.5. The Organiser reserves the right to select any artworks at any time within the duration of the Contest and after it and post them on any sections of the official social media pages belonging to the Organiser or any other Internet site.
11. General Conditions
11.1. The Organiser reserves the right to disqualify any participant who violates these Rules.
11.2. The Organiser reserves the right to demand written confirmation of acceptance of these Rules.
11.3. The Participant grants the Organiser the right to use their name, picture, voice, and biographical data in connection with the Contest and its promotion.
11.4. The Organiser is not responsible for any technical issues or other circumstances that may prevent a participant from participating in the Contest. The Organizer does not bear liability for lost, wrongly addressed, damaged, or mistakenly provided data. The Organiser is not liable for any losses or damages resulting from or in connection with the Contest, including loss of information or transfer of computer viruses during communication, infringement of copyrights and other rights of third parties, submission of incorrect information by an entrant, and breach of these Rules, Contest Conditions.
11.5. If an entrant raises a complaint or makes a claim against persons other than the Organiser concerning the Contest and/or the Gifts, such complaints and claims shall not involve the Organiser.
11.6. The Organiser reserves the right to modify these Rules at any time without prior notice.
11.7. The Organiser reserves the right to final and ultimate interpretation of these Rules
11.8. By participating in the Contest, participants agree to comply with all the terms and conditions outlined in this document.
